These Terms and Conditions ("Terms") constitute a binding legal agreement between you and WestFinanceBank, N.A. ("WestFinanceBank," "we," "our," or "us"). By creating an account, accessing our website, mobile application, or any of our financial products, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and any additional guidelines or rules applicable to specific services.
If you are using our services on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

We reserve the right to refuse account opening to any applicant at our sole discretion and in compliance with applicable law.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support if you suspect any unauthorized use of your account.
WestFinanceBank may, at its discretion, refuse to process, reverse, or place holds on transactions that it determines in good faith may violate these Terms, applicable law, or that appear suspicious or fraudulent.
Joint accounts are governed by a separate agreement provided at account opening. Each account holder is individually and jointly liable for all obligations arising from the joint account.
WestFinanceBank provides a range of financial services including but not limited to: checking and savings accounts, wire transfers, bill payment, investment accounts, mortgage products, and business banking solutions. Specific terms applicable to each product are set out in the relevant product disclosure documentation provided to you at onboarding.
We may modify, suspend, or discontinue any service or feature at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of services.
Applicable fees are described in our Fee Schedule, which is incorporated into these Terms by reference and is available on our website and upon request. Fees may include, without limitation: monthly maintenance fees, overdraft fees, wire transfer fees, international transaction fees, and early account closure fees.
We reserve the right to amend our fee schedule upon 30 days' written notice (or such shorter period as required by applicable law). Continued use of our services after the effective date of a fee change constitutes your acceptance of the new fees.
To the fullest extent permitted by law, WestFinanceBank shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of goodwill, arising out of or in connection with your use of our services.
Our aggregate liability to you for any cause whatsoever, and regardless of the form of the action, shall at all times be limited to the greater of: (a) the amount paid by you to us in the twelve months preceding the claim, or (b) $100 USD.
Nothing in these Terms excludes or limits liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
Your privacy is important to us. Our Privacy Policy explains how we collect, use, disclose, and protect your personal information and is incorporated into these Terms by reference. By using our services you consent to the data practices described in our Privacy Policy.
Either party may terminate the account relationship at any time. You may close your account by contacting us through our Support page. We reserve the right to close your account immediately and without notice if we determine that you have violated these Terms, engaged in fraudulent activity, or for any other reason permitted by applicable law.
Upon termination, all provisions of these Terms that by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
In the event of a dispute, you agree to first contact us at support to attempt to resolve the dispute informally. If a dispute cannot be resolved informally within 30 days, both parties agree to submit to binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings conducted in New York, NY.
You waive any right to a jury trial or to participate in a class action lawsuit with respect to any dispute arising out of or relating to these Terms or our services.
We reserve the right to modify these Terms at any time. We will provide notice of material changes via email to your registered address or via a prominent notice on our website or mobile application. Your continued use of our services after any such change constitutes your acceptance of the new Terms.
